• The living will needs to be made in front of a notary to become a public document with binding force
• Expert opinion of a psychiatrist made not more than one month before the statement is necessary for the validity of the AD

Based on the article 22.(1) of the Parliamentary Act CLIV. of 1997 on Health Care (HCA), an AD made in front of a notary becomes a public document legally binding.

Under the article 22.(2) of the Parliamentary Act CLIV. of 1997 on Health Care (HCA), it is possible to appoint a healthcare proxy to take decisions about the refusal of life saving and life sustaining treatments.

Government decree No 117/1998. (VI. 16.) [Hungarian:117/1998. (VI. 16.) Korm. Rendelet] details the rules on the refusal of certain health care services.

There is no official registry on Advance Directives in Hungary, therefore it is not possible to know the number of ADs registered by citizens.
