Saskatchewan is a prairie province in Canada, which has an area of 588,276.09 square kilometres (227,134.67 sq mi) and a population of 1,010,146 (according to 2008 estimates). The provincial capital is Regina. The 2006 census showed a population of 985,386.

  • Every competent person who is at least 16 years of age may make a health care directive.
  • Individuals may also may appoint proxies to make health care decisions on their behalf in case they become unable to make these decisions themselves.
  • A proxy must be 18 years of age and must have the capacity to make health care decisions. Where a directive does not give directions for specific circumstances, and no proxy has been appointed or is willing or able to act, the nearest relative of the person can make a decision on his or her behalf.
  • A directive must be in writing, dated and signed by the person and one witness who is not the proxy or the proxy's spouse.
  • There in not a compulsory form of AD in Saskatchewan, but the AD declaration needs to meet the criteria mentioned above.
  • A person may revoke a directive orally, in writing, by destroying the directive, or by making a new directive.
  • When a court is satisfied a proxy or nearest relative is not acting in good faith, the court may rescind any decision made and appoint another relative to make a health care decision, or may substitute the court's decision for the decision of the proxy

Living Wills Registry. www.livingwills.com. The Registry (not official), was established by Dr David Williams, a Stratford family physician, and his wife Maureen in 1992. The Registry's mandate is to assist people in directing their own medical treatment in the event of incapacitating illnesses or injuries.

  6. Is valid a directive made outside Saskatchewan?

    A directive made outside Saskatchewan that complies with the requirements of this Act is deemed to be a directive made pursuant to this Act.
